GENERAL TERMS AND CONDITIONS
DAVAN Driving School
Effective from 1 September 2026
I. General Provisions
1.1. These General Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) govern the mutual rights and obligations relating to the provision of driving courses and other related services between DAVAN s. r. o., with its registered office at Záhradná 34A, 044 31 Družstevná pri Hornáde, Company ID No. (IČO): 56 803 842, Tax ID No. (DIČ): 2122449450, VAT ID No. (IČ DPH): SK2122449450, registered in the Commercial Register of the District Court Banská Bystrica, Section: Sro, Insert No. 51448/S, with driving school premises at Magnezitárska 2/A, 040 22 Košice, e-mail: autoskola@davan.sk, tel.: +421 944 753 755 (hereinafter referred to as the “Driving School”), and a person enrolled in a driving course (hereinafter referred to as the “Student”), unless otherwise agreed between the parties.
The current version of these Terms and Conditions is published on the website www.davan.sk.
1.2. For the purposes of these Terms and Conditions, a course means primarily a driving course aimed at obtaining a Category B driving licence, or another type of course included in the Driving School's current offer. The Driving School provides courses in accordance with Act No. 93/2005 Coll. on Driving Schools and on Amendments and Supplements to Certain Acts, as amended, and in accordance with the applicable curriculum.
1.3. The contractual relationship between the Student and the Driving School is established upon acceptance of the application by the Driving School and payment of the course fee, or the first instalment thereof where an instalment plan has been agreed. Payment must be made no later than the commencement of the course.
1.4. Where the contract is concluded remotely without the simultaneous physical presence of the Driving School and the Student, for example through an online application on www.davan.sk, the relevant provisions of Act No. 108/2024 Coll. on Consumer Protection and on Amendments and Supplements to Certain Acts shall also apply.
1.5. A Student who is a consumer is a natural person who, when entering into and performing the contract, does not act within the scope of their business activity, employment or profession.
For the purposes of registration for the course and fulfilment of the Driving School's statutory obligations, the Student shall provide the necessary identification and contact details, in particular their first name and surname, address, date of birth, telephone number, e-mail address and any other information required by applicable legislation.
1.6. Following receipt of the application, the Driving School will contact the Student no later than within five working days. During this communication, the Driving School will verify the application and provide the Student with information regarding the expected commencement date of the course, the final price and the method of payment.
1.7. The specific date on which a course is opened and commenced depends primarily on the number of enrolled Students and the Driving School's current capacity.
II. Course Fee and Payment
2.1. By entering into the contract, the Student undertakes to pay the agreed course fee and to participate properly in the instruction and training.
2.2. The course fee is determined according to the Driving School's current price list published on www.davan.sk, valid at the time the application is submitted, taking into account any discounts applied and accepted by the Driving School.
The stated price includes VAT at the rate prescribed by law. The Driving School may amend its price list; however, any price change shall not affect contracts concluded before the new price list takes effect. Before submitting an application, the Student has the opportunity to become acquainted with the total course fee and any related charges.
2.3. The course fee may be paid in cash or by bank transfer or deposit into the Driving School's account:
a) as a single payment before the commencement of the course, or
b) in two or three instalments according to the agreed instalment plan and the duration of the course.
When paying in instalments, the first instalment must be paid before the commencement of the course. The Driving School will inform the Student of the due dates, number and amounts of the remaining instalments when verifying the application.
2.4. If the Student is more than 14 days late with the payment of an instalment, the Driving School may temporarily suspend the Student's training until the outstanding amount has been paid. During this period, the Student may not be permitted to schedule or complete practical driving lessons or participate in instruction.
If the delay exceeds 30 days, this constitutes a material breach of the contractual terms and the Driving School is entitled to withdraw from the contract. The subsequent financial settlement shall be carried out in accordance with Section 6.3 of these Terms and Conditions.
2.5. If the course fee or part thereof is financed through an approved retraining contribution (e.g. RE-PAS), the method of payment shall be governed by the rules of the competent authority. Any portion of the price not covered by the contribution shall be paid by the Student.
III. Organisation and Course Structure
3.1. Instruction and training are provided in accordance with applicable legislation and the mandatory curriculum. Practical training is provided by professionally qualified instructors.
3.2. The course includes theoretical instruction, practical training using a simulator or at a training ground, and practical driving in road traffic to the extent prescribed by the applicable curriculum.
The course also includes a first aid course, including an examination, which the Driving School will arrange on one announced date, as well as access to an application used for scheduling driving lessons. Access to this application is included in the course fee.
3.3. The Student is required to complete the training no later than 12 months from the date on which it commenced. Once this period has expired without completion, the training can no longer be completed under the applicable law.
If the Student fails to complete the course within this period for reasons attributable to the Student, this shall be considered an early termination of the course by the Student pursuant to Section 6.2.
3.4. The date of the final examination is determined by the competent authority of the Police Force. The Driving School therefore cannot guarantee or influence a specific examination date. Once all required conditions have been met, the Driving School will register the Student for the examination and provide the necessary assistance.
3.5. In addition to the mandatory training, the Student may order additional driving lessons or supplementary training, including refresher driving lessons. The applicable fee shall be determined according to the Driving School's current price list.
IV. Booking, Rescheduling and Cancellation of Practical Driving Lessons
4.1. Practical driving lessons are booked through the application intended for scheduling driving lessons or by agreement with the instructor.
The Student is required to arrive at the agreed time punctually and, both before and after the driving lesson, complete the necessary record-keeping procedures in accordance with the instructor's instructions, for example by using an identification card or making a record in the relevant system.
4.2. The Student may cancel a booked driving lesson free of charge no later than 24 hours before the scheduled start of the lesson, either through the application or by notifying the instructor.
4.3. If a driving lesson is cancelled less than 24 hours before its scheduled start, or if the Student fails to attend the booked lesson, the lesson shall be forfeited and the Student shall be required to pay a fee of EUR 20.
The fee shall not apply if the Student demonstrates serious circumstances worthy of special consideration that objectively prevented them from attending the lesson, such as a sudden illness supported by a medical certificate.
4.4. If the Student arrives more than 15 minutes late, this shall be considered a failure to attend the driving lesson and Section 4.3 shall apply.
4.5. If a driving lesson must be cancelled by the Driving School or the instructor, the Student shall not be required to pay any fee. At the same time, the Driving School shall offer the Student a replacement date without undue delay.
4.6. The Student must not participate in a practical driving lesson while under the influence of alcohol, narcotic or psychotropic substances, or in any other condition that reduces their ability to operate a motor vehicle safely.
If the instructor identifies such a condition, the instructor is entitled not to conduct the driving lesson. Such a lesson shall subsequently be treated in the same manner as the Student's failure to attend under Section 4.3.
V. Obligations of the Driving School
The Driving School undertakes in particular to:
a) provide instruction and training in accordance with the mandatory curriculum and generally binding legal regulations,
b) provide practical training through professionally qualified instructors and vehicles meeting the relevant technical requirements,
c) ensure that the Student is insured during practical training,
d) after all training requirements have been fulfilled, register the Student for the final examination and provide the necessary assistance in connection with taking the examination.
VI. Cancellation of Application, Early Termination of the Course and Withdrawal from the Contract
6.1. Cancellation of the Application Before the Commencement of the Course
The Student may cancel their application at any time before the commencement of the course. The cancellation must be communicated to the Driving School in writing; for this purpose, e-mail shall also be considered to constitute written form.
If the application is cancelled, the Driving School is entitled to a cancellation fee of EUR 100, which is intended to cover administrative costs and reserved capacity.
If the Student has already paid a higher amount, the Driving School shall refund the remaining amount within 14 days of receiving the cancellation notice, using the same payment method by which the payment was received, unless the parties agree otherwise.
6.2. Early Termination of the Course by the Student
After the course has commenced, the Student may terminate the course early at any time by delivering written notice to the Driving School. The notice may also be sent by e-mail.
In such a case, the Driving School shall be entitled to:
a) an early termination fee of EUR 300, representing a lump-sum reimbursement of costs associated in particular with administration, organisation of the course and reserved instructor and vehicle capacity,
b) payment for all practical driving lessons actually completed by the Student up to the date of termination of the course, at a rate of EUR 30 for each completed driving lesson.
6.3. Settlement Following Termination of the Course
No later than 14 days after termination of the course, the Driving School shall prepare a financial settlement. From the amount paid by the Student, it shall deduct the claims arising under Section 6.2(a) and (b), or any claims arising under Section 6.4.
If there is an overpayment, the Driving School shall refund it to the Student within 14 days of preparing the settlement. If the amount already paid is insufficient to cover the Driving School's claims, the Student shall pay the outstanding balance within 14 days of receiving the settlement.
The total amount of the Driving School's claims under Section 6.2 shall not exceed the total course fee agreed upon at the time of enrolment.
6.4. Termination of the Contract by the Driving School
The Driving School may withdraw from the contract in the event of a serious breach of the Student's obligations. Such a breach includes, in particular, late payment pursuant to Section 2.4, repeated unjustified absence from instruction or driving lessons, participation in practical training while under the influence of alcohol or other addictive substances, or conduct by the Student that endangers the instructor or other persons or seriously disrupts the training process.
In such a case, the settlement shall be carried out in accordance with Section 6.3, taking into account the claims under Section 6.2.
6.5. Withdrawal from a Distance Contract
If the contract was concluded at a distance, the Student has the right to withdraw from it without giving any reason within 14 days from the conclusion of the contract.
If the Student expressly requested that the Driving School begin providing services before the expiry of this period and the provision of services has already commenced, the Student shall, upon withdrawal, be required to pay for the services actually provided up to the time of withdrawal.
If the service has been fully provided with the Student's express consent, the Student loses the right to withdraw from the contract.
The withdrawal may be delivered electronically to autoskola@davan.sk or in writing to the Driving School's premises at Magnezitárska 2/A, 040 22 Košice.
VII. Complaints and Dispute Resolution
7.1. If the Student has any objections regarding the quality or scope of the services provided, they may submit a complaint by e-mail to autoskola@davan.sk or in writing at the Driving School's premises at Magnezitárska 2/A, 040 22 Košice.
The Driving School shall provide the Student with confirmation that the complaint has been submitted and shall resolve the complaint without undue delay, but no later than within 30 days of its submission.
7.2. If the Student is not satisfied with the manner in which the complaint has been handled or believes that the Driving School has infringed their rights, the Student may request remedy from the Driving School.
If the Driving School rejects the request for remedy or fails to respond within 30 days, the Student may submit a proposal to initiate alternative dispute resolution proceedings before the competent alternative dispute resolution entity pursuant to Act No. 391/2015 Coll. Such an entity is, in particular, the Slovak Trade Inspection.
7.3. The supervisory authority is the Slovak Trade Inspection, Inspectorate of the Slovak Trade Inspection for the Košice Region. Within the scope of the Driving School's activities, the competent District Office in the seat of the region also exercises the relevant supervision.
VIII. Personal Data Protection
8.1. DAVAN s. r. o. processes Students' personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act No. 18/2018 Coll. on Personal Data Protection.
Personal data is processed primarily to the extent necessary for entering into and performing the contractual relationship and for fulfilling the Driving School's statutory obligations, including the relevant records maintained in the Unified Information System for Road Transport.
Further information regarding the processing of personal data, the legal bases for processing and the rights of data subjects is provided in a separate Privacy Policy published on www.davan.sk.
8.2. Photographs, video recordings or other visual material captured during the course may be used by the Driving School for marketing and promotional purposes only if the Student has provided separate and voluntary consent for such use.
The Student may withdraw such consent at any time, and granting such consent is not a condition for participating in the course or receiving the Driving School's services.
IX. Final Provisions
9.1. The rights and obligations relating to the liability of the Driving School and the Student for any damage shall be governed by generally binding legal regulations. During practical training, the Student is insured in accordance with Section V(c) of these Terms and Conditions.
9.2. The Driving School is entitled to reasonably amend or update these Terms and Conditions. However, the version of the Terms and Conditions valid and effective at the time the contract with the Student was concluded shall apply to the relevant contractual relationship.
9.3. If any provision of these Terms and Conditions is found to be invalid or ineffective, this shall not affect the validity and effectiveness of the remaining provisions.
9.4. By submitting the application, the Student confirms that they had the opportunity to review these Terms and Conditions before entering into the contract, that they understood their content and that they agree to them.
9.5. These General Terms and Conditions shall take effect on 17 September 2026. The contractual relationship between the Driving School and the Student shall be governed by the version of the Terms and Conditions effective at the time the relevant contract was concluded.
